TERMS OF SERVICE
Before you step
onto MockAllies.
The legal terms that govern your use of MockAllies and your relationship with us.
↓You agree to
these terms.
These Terms of Service ("Terms") form a binding agreement between you and [BUSINESS LEGAL NAME] ("the Company," "we," "us," "our"), a [JURISDICTION] entity. By creating an account, accessing MockAllies, or using any of our services, you agree to be bound by these Terms in their entirety. If you do not agree, you may not use MockAllies.
We may update these Terms at any time without prior notice. Your continued use of MockAllies after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically for changes.
Who can use
MockAllies.
You represent and warrant that: (1) you are at least 18 years of age; (2) you have the legal capacity and authority to enter into this agreement; (3) the information you provide during registration is accurate, current, and complete; and (4) you will maintain the confidentiality of your account credentials and accept responsibility for all activity that occurs under your account.
You agree not to create multiple accounts, use false information, or attempt to impersonate another user. The Company reserves the right to suspend or terminate accounts that violate this requirement or that engage in fraudulent, abusive, or prohibited conduct at any time.
Account registration requires a valid email address. You are responsible for maintaining the accuracy of your registration information and for any communications sent to the email address associated with your account.
How billing
works.
Subscription Plans: MockAllies offers recurring subscription plans with pricing and billing terms as displayed at purchase. Subscriptions auto-renew on the date they expire unless you cancel before the renewal date. You authorize the Company to charge your payment method on file for each renewal. Cancellation takes effect at the end of your current billing cycle; you retain access through the end of that cycle even after requesting cancellation.
Credit Packs and Practice-Time Packs: One-time purchases of call credits or practice-time minutes are non-refundable once consumed or partially consumed. Unused credits expire after [CREDIT EXPIRY PERIOD]. Once the expiration date passes, remaining credits are forfeited and cannot be restored or refunded. Expiration dates are displayed in your account settings.
Billing: Payment is processed by Stripe, our payment processor. You authorize the Company and Stripe to charge your payment method for amounts owed under these Terms. Billing disputes or questions about your charges should be directed to [SUPPORT EMAIL]. Fraudulent, declined, or failed payment attempts may result in temporary or permanent suspension of your account.
Free Trials: If you receive a free trial or promotional access period, it is provided for evaluation purposes only. Upon trial end, you will be required to enter billing information to continue using MockAllies. If you do not cancel before the trial expires, your subscription will convert to a paid plan and you will be charged [PRICING DETAILS].
Your right to
change your mind.
Statutory Right of Withdrawal: If you are a consumer in the European Union or United Kingdom, you have the right to cancel your subscription within 14 calendar days of purchase, without giving reason, and receive a full refund. This right does not apply if you have explicitly consented to immediate performance (i.e., your subscription becoming active before the 14-day period ends) or if you have already received practice sessions, session recordings, or consumed credit.
Explicit Consent to Immediate Performance (for EU/UK only): If you wish to begin using MockAllies immediately and do not wish to retain the 14-day withdrawal right, you may consent to immediate performance at checkout. We will present this consent option clearly and separately from the purchase button. By consenting to immediate performance, you understand and accept that you forfeit the statutory 14-day withdrawal right for that purchase, and no refund will be issued once you have begun using MockAllies or consumed any practice sessions.
How to Exercise Your Right: To cancel your subscription, log in to your account, navigate to Account Settings, and select "Cancel Subscription." Cancellation becomes effective at the end of your current billing period. If you prefer to cancel by email, contact [SUPPORT EMAIL] with your account email and request. Cancellations initiated within the 14-day withdrawal period (and without consent to immediate performance) will receive a refund to your original payment method within 14 business days.
Non-EU/UK Consumers: If you are located outside the EU and UK, you do not have a statutory 14-day withdrawal right. Subscription cancellation takes effect at the end of your current billing cycle, and no refund of fees already paid is issued. Credit packs and practice-time packs are non-refundable once purchased.
What you upload,
what you say.
When you use MockAllies, you may record practice sessions, submit written responses, and interact with simulated buyer personas. All audio recordings, transcripts, written submissions, and session data you create are your responsibility.
Your Warranties: You represent and warrant that: (1) any content you upload, submit, or share does not infringe the intellectual property, privacy, or other rights of any third party; (2) you have obtained all necessary consent from any person whose voice, name, personal data, or likeness appears in your uploads or recordings; (3) you do not upload recordings of real third parties, real prospects, real customers, or real clients without their explicit written consent; (4) you do not upload, submit, or reference confidential, proprietary, regulated personal data (including credit card numbers, social security numbers, health information, financial account details, or similar sensitive data); and (5) all content is true, accurate, and not created with the intent to deceive, defraud, or cause harm.
Prohibited Content: Do not upload or submit recordings of others' private conversations, real business calls, or confidential business information. Do not use MockAllies to record or store any data subject to GDPR, HIPAA, FERPA, PCI, or other regulated confidentiality frameworks without explicit legal approval. The Company is not responsible for your compliance with those frameworks if you choose to submit such data.
Consequences of Breach: If you breach these warranties, you agree to indemnify and hold harmless the Company, its officers, employees, and agents from any claims, damages, or costs arising from third-party rights violations, privacy complaints, or regulatory investigations related to your content. The Company reserves the right to remove any content that appears to violate these warranties and to suspend or terminate your account without refund.
MockAllies is
practice, not advice.
MockAllies uses artificial intelligence (Google Gemini Live API) to simulate buyer personas and provide feedback on your practice sessions. This AI-generated feedback and simulated conversations are for educational and training purposes only.
Disclaimer: We make no representations that AI feedback is professional sales coaching, career advice, guaranteed to improve your sales results, or a substitute for guidance from a qualified sales manager, trainer, or legal advisor. Sales conversations with different buyers in real-world conditions may not follow the patterns you practice here. Results depend on many factors outside MockAllies's scope: your market, your product, your organization's strategy, and the specific buyer you face.
Not Professional Advice: Feedback generated by MockAllies is not professional sales coaching, legal advice, financial advice, or medical advice. You use all feedback at your own risk. If you need professional guidance in any area, consult a qualified professional.
Simulated Buyer Limitations: The AI buyer personas are programmed simulations, not real conversations with real buyers. Real buyers are unpredictable, use different language, and may respond in ways the simulation does not capture. Do not assume that a successful practice session will transfer unchanged to a real call.
How we handle
your sessions.
All practice sessions are recorded, transcribed, and stored on our servers so you can replay them, review feedback, and track your progress. You consent to this recording and storage by using MockAllies.
Explicit Commitment on Session Use: We commit to the following, in full:
— We do not create voiceprints or perform speaker identification or voice-biometric matching on your session audio.
— We do not use your session audio, transcripts, or any data you provide to train, fine-tune, or improve any AI models, including Google Gemini or any other model we use in the future.
— We do not share your session audio, transcripts, or personal data with third parties for their own use, marketing, or training purposes.
Your session recordings and transcripts are shared only with: (1) our cloud storage provider (Supabase) for secure storage; (2) Google Gemini Live API (paid tier, which does not use your prompts or responses for model training, per Google's terms for paid API users); and (3) you, for your own review and access. No other third party has access to your recordings or transcripts unless you explicitly authorize it or we are required by law to disclose it.
Retention Period: Session recordings and transcripts are retained for [RETENTION PERIOD], after which they are automatically deleted from our systems. This retention period is enforced by automated deletion and is non-negotiable for all users. If you wish to preserve a session, you must download or export it before the retention period expires.
What we're not
responsible for.
To the maximum extent permitted by law, MockAllies and the Company provide the service "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, secure, or free from viruses.
Curriculum and Training Materials: MockAllies's Academy curriculum, lesson materials, and sales-call transcripts in our lesson library are provided without warranty. We do not guarantee the accuracy, timeliness, applicability, or legal compliance of any curriculum content. You use all training materials at your own risk and assume all responsibility for their use and application.
AI Buyer Persona Accuracy: The AI buyer personas are simulations based on common patterns. We do not warrant that they accurately represent any real buyer, that practicing with them will improve your sales performance, or that their responses follow real-world buyer behavior.
Liability Limitation: Except where prohibited by law, the Company's total liability to you for any claim arising from or related to your use of MockAllies shall not exceed the greater of: (1) the total amount of fees you paid to the Company in the 12 months immediately preceding the claim, or (2) $50 USD. This cap applies whether the claim is for contract breach, tort, negligence, strict liability, or any other theory, and whether or not the Company has been advised of the possibility of such damages.
No Liability for Consequential Damages: In no event shall the Company be liable for lost profits, lost revenue, lost data, lost goodwill, lost business opportunity, or any other indirect, incidental, special, or consequential damages, even if we have been advised of the possibility of such damages.
What's yours,
what's ours.
You retain all ownership and copyright in any content you create and upload to MockAllies. By uploading content, you grant the Company a non-exclusive, worldwide, royalty-free license to store, display, and replay your recordings and transcripts to you for training and feedback purposes only.
Curriculum Content: All Academy lessons, lesson materials, sales scripts, scenario templates, sales-call transcripts in our library, and training videos are the intellectual property of the Company or its licensors. You may not copy, distribute, modify, republish, or use any curriculum content outside MockAllies's service without express written permission. No warranty is offered regarding the originality, clearance, or third-party rights compliance of any curriculum material. While we have sourced curriculum from our own team and licensed or permitted-use materials from third parties, we do not warrant that every transcript or scenario has been formally cleared against all potential third-party claims. You assume all risk if you choose to use curriculum materials outside MockAllies's walled garden.
Your License to Use MockAllies: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use MockAllies in accordance with these Terms for your personal, non-commercial training purposes only. You may not resell, redistribute, or sublicense access to MockAllies.
